Biography


A background in chemistry allows Erin Formby to confidently address complex and technology centric matters. With a passion for the law and desire to learn, Erin found her calling in trial work. Described as intellectually curious and a perpetual learner, she finds comfort digging deep into facts and research regarding new subject matters to uncover unique solutions for her clients.

Erin formerly worked as a litigator in the Houston office of a global law firm focusing on complex international commercial arbitration, domestic commercial arbitration, and domestic litigation in both state and federal courts. Her representation of corporate and individual clients spans a diverse range of business sectors, including energy, infrastructure, technology, and retail. Erin’s experience encompasses disputes arising from purchase and sale agreements, energy contracts, Joint Operating Agreements, sales of goods, and licensing agreements.

While receiving her J.D. from Harvard Law School, Erin served as a student attorney for the Immigration and Refugee Clinic, Domestic Violence and Family Law Clinic, and the International Human Rights Clinic. She also spent a semester during law school studying abroad in Bogotá, Colombia where she further honed her Spanish skills. Following law school, Erin served as a Harvard Law School Public Service Venture Fund Fellow, returning to Bogotá to work with a Colombian organization on its domestic and international litigation projects. She credits this work as one of her most meaningful moments as a lawyer. Due to her experiences living and working in Latin America, Erin is professionally fluent in Spanish and has even represented a witness who testified in Spanish in an ICDR arbitration and not only defended his testimony, but also corrected translation for the record.

A Texas native with Canadian influences, Erin enjoys all things sports including being an avid Houston Astros and Dallas Stars fan. She also enjoys bringing her friends together once a week for dinner, drinks, and reality TV. When she’s not entertaining or watching sports, Erin likes to unwind at Pilates and do anything in the countryside or on the water.

Representative Matters


Litigation and Commercial Disputes

  • Represented State-owned Asian firm through final hearing in AAA arbitration arising from a long-term contract for crude oil storage at an offshore tank farm.
  • Defended international energy producer in AAA arbitration with the owner of an offshore pipeline system who asserted claims exceeding US$170 million, which arbitration resulted in a take-nothing award for the Claimant.
  • Defended small business against trade secret misappropriation and Computer Fraud and Abuse Act claims in Texas federal court.
  • Assisted Texas finance firm with negotiating a settlement with a technology start-up firm stemming from a technology service agreement.
  • Advised Canadian energy firm regarding its participation as a non-party in domestic litigation in Wyoming federal court arising from transportation agreement.
  • Advised US manufacturing company on likelihood of success for recovering on a breach of contract claim against foreign State-owned entity in Texas state court.

International Arbitration

  • Represented subsidiary of US energy firm in ICDR arbitration under Colombian law arising from a purchase and sale agreement for sale of rights to oil producing properties in Colombia.
  • Advised US technology company regarding international arbitration procedures as defined in client’s licensing agreement with Asian counterparty.
  • Drafted international arbitration clause for US midstream firm’s crude oil sale agreements with international parties.

International Litigation

  • Assisted with defending an Australian energy firm in the Supreme Court of Queensland from claims arising under a Joint Operating Agreement governed by Texas law.

Other Highlights

  • Drafted weapons and firearms policy for major retailer with presence in over 40 US states upon conducting survey of laws regarding weapons and firearms in applicable jurisdictions.
