Mike Oldham, Jeremy Doyle, and Harris Wells represented BlueCrest Energy in an arbitral dispute against Baker Hughes. The dispute arose from the catastrophic failure of a deep horizontal well that BlueCrest was drilling in Kenai, Alaska. BlueCrest alleged that drilling operations were disrupted during well completion operations by the failure of a Baker Hughes tool, causing more than $35 million in direct damages. Baker Hughes commenced the arbitration, ostensibly seeking recovery for unpaid invoices related to its work on the well. BlueCrest counterclaimed, alleging that Baker Hughes was grossly negligent in its operation of its tool assembly shop on the Kenai Peninsula and in the assembly of the failed downhole tool. The matter settled in spring 2019 before commencement of the final arbitration hearing.
